Terms of Service

1. Acceptance of Terms

By accessing or using SwimTrack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 13 years old to create an account and use this Service. By using the Service, you represent that you meet this age requirement. Parents or guardians may use the Service to track their children's swim times.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Use of the Service

You agree to use the Service only for lawful purposes, for your own personal, non-commercial use, and in accordance with these Terms.

5. Prohibited Uses

You agree not to:

  • Scrape, crawl or spider the Service, or use bots or any other automated means to access it or to copy, download or collect its data, except through export or download features we provide for that purpose
  • Copy, reproduce, republish, sell or redistribute the Service's compiled data, including its meets, results, times, rankings, Power Index scores and time standards, or use that data to build a competing database or service, without our written permission
  • Access the Service's application programming interfaces (APIs) other than through our own websites and apps, unless we have given you written permission
  • Get around, disable or interfere with any security feature, rate limit or access control of the Service
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
  • Interfere with or disrupt the Service, its servers or its networks, or place an unreasonable load on them
  • Upload malicious code or content
  • Collect information about other users without their consent
  • Use the Service in any way that suggests SwimTrack is affiliated with, sponsors or endorses you, your organization or your product
  • Use the Service for commercial purposes without our written permission
  • Use the Service for any unlawful purpose or in violation of any applicable law

We may suspend or terminate access for anyone who violates this section, as described under Termination.

6. User Content

You retain ownership of content you submit to the Service (swimmer data, photos, times). By submitting content, you grant us a license to use, store, and display that content solely to provide the Service to you.

You are responsible for ensuring you have the right to submit any content, including photos of minors (which should only be of children for whom you have parental/guardian responsibility).

7. Times, Time Standards and Data

The Service may include times, time standards and data from various public sources for comparison purposes. These times and standards are provided for informational purposes only and may not reflect the most up to date times or official standards. Always verify official qualifying times and standards with the relevant organization.

8. Data Availability Disclaimer

Meet results and related data are provided on a best-effort basis. We do not guarantee complete, continuous, or current coverage for any specific period or organization, and availability may vary due to factors outside our control — including third-party restrictions, policy changes, or the discontinuation of data sources. As a result, certain meets, results, or rankings may not be accessible at all times. Use of the application constitutes acceptance of these limitations.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time through the Settings page.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
